NOTICE OF HEARING ON ANNEXATION AND ZONING

Public Hearing will be held before the Town Council of the Town of Ellendale to consider the following:

1. Review of an Annexation Petition and Zoning Request for a parcel of land totaling 11.36 acres located along Sylvia Avenue, Ellendale and identified as tax parcels 230-27.00-1.01 in a deed recorded with the Sussex County Recorder of Deeds in Book 5618 on Page 49. The property is currently zoned GR (General Residential) in Sussex County. The proposed zoning is R-3 (General and Multifamily Residential Use District). The property is located on the east side of Sylvia Avenue and west of Penn Central Railroad tracks. The annexation category according to the Ellendale’s 2020 Comprehensive Plan is Phase 1 and the land use designation is a mix of Residential and Commercial. Petitioned by the owner, John Herholdt, and the parcel is subject to an Annexation Agreement with the developer, Insight Homes.

2. Review of an Annexation Petition and Zoning Request for five parcels of land totaling 82.39 acres located on North Old State Road, Ellendale, across from Gladys Street, and not currently having a street address. The property is identified as tax parcels 230-26.00-37.00 totaling 79.36 acres, 230-26.00-37.02 totaling 0.76 acres, 230-26.00-37.03 totaling 0.76 acres, 230-26.00-37.04 totaling 0.76 acres, and 230-26.00-37.05 totaling 0.76 acres in a deed recorded with the Sussex County Recorder of Deeds in Book 2414 on Page 196. The property is currently zoned GR (General Residential) and AR-1 (Agricultural Residential) in Sussex County. The proposed zoning is R-3 (General and Multifamily Residential Use District) with a Large Parcel Overlay District. The property is located west of North Old State Road, south of Fleatown Road, east of DuPont Boulevard, and north of Beach Highway. The annexation category according to the Ellendale’s 2020 Comprehensive Plan is Phase 1 and the land use designation is Residential and Commercial. Petitioned by the owners, Robert & Linda Garey, and is subject to an Annexation Agreement with the developer, Common Sense Solutions.

3. Review of an Annexation Petition and Zoning Request for a parcel of land totaling 0.26 acres located at 18148 Beach Highway, Ellendale. The property is identified as tax parcel 230-26.00-12.00 in a deed recorded with the Sussex County Recorder of Deeds in Book 5570 on Page 74. The property is currently zoned AR-1 (Agricultural Residential) in Sussex County. The proposed zoning is R-2 (Single-Family Residential Use). The property is located west of South Old State Road, south of Beach Highway, east of DuPont Boulevard, and north of Sharons Road The annexation category according to the Ellendale’s 2020 Comprehensive Plan is Phase 1 and the land use designation is Residential. Petitioned by the owner, Jose Fernandez, and the parcel is not subject to an Annexation Agreement.

4. Review of an Annexation Petition and Zoning Request for a parcel of land totaling 52.23 acres located at 18019 Beach Highway, Ellendale. The property is identified as tax parcel 230-26.00-39.00 in a deed recorded with the Sussex County Recorder of Deeds in Book 2763 on Page 97. The property is currently zoned C-1 (General Commercial) and AR-1 (Agricultural Residential) in Sussex County. The proposed zoning is RB (Residential-Business). The property is located west of North Old State Road, south of Fleatown Road, east of DuPont Boulevard, and north of Beach Highway. The annexation category according to the Ellendale’s 2020 Comprehensive Plan is Phase 1 and the land use designation is Residential and Commercial. Petitioned by the Town Council of the Town of Ellendale and the parcel is not subject to an Annexation Agreement.

5. Review of an Annexation Petition and Zoning Request for a parcel of land totaling 11.55 acres located at 12497 DuPont Boulevard, Ellendale. The property is identified as tax parcel 230-26.00-39.01 in a deed recorded with the Sussex County Recorder of Deeds in Book 4955 on Page 324. The property is currently zoned C-1 (General Commercial) in Sussex County. The proposed zoning is C-3 (Highway Commercial). The property is located west of North Old State Road, south of Fleatown Road, east of DuPont Boulevard, and north of Beach Highway. The annexation category according to the Ellendale’s 2020 Comprehensive Plan is Phase 1 and the land use designation is Residential and Commercial. Petitioned by the Town Council of the Town of Ellendale and the parcel is not subject to an Annexation Agreement.

6. Review of an Annexation Petition and Zoning Request for a parcel of land totaling 189 acres located along DuPont Boulevard, Ellendale. The property is identified as tax parcel 230-26.00-15.00 in a deed recorded with the Sussex County Recorder of Deeds in Book 4850 on Page 82. The property is currently zoned AR-1 (Agricultural Residential) in Sussex County. The proposed zoning is R-3 (General and Multifamily Residential Use District) and C-3 (Highway Commercial) with a Large Parcel Overlay District. The property is located west of DuPont Boulevard, south of Staytonville Road, east of Webbs Road, and north of Beach Highway. The annexation category according to the Ellendale’s 2020 Comprehensive Plan is Phase 1 and the land use designation is Residential and Commercial. Petitioned by the owner, Six Green Lands LLC, and the parcel is subject to an Annexation Agreement.

A public hearing has been scheduled for Tuesday, January 17, 2023, at 7:00 PM before the Town Council. Written comments will also be accepted prior to the conclusion of the public hearing via mail to Town of Ellendale, P.O. Box 6, Ellendale, DE 19941.
